CONSUMER - DEFINITION

An individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession.

TERMS

The placing of an order shall include acceptance of the following terms and conditions. Only our terms shall apply and shall not be deemed as forming part of any other contract; no terms, conditions or reservations stipulated by the buyer. No variations to any of these conditions will apply unless expressly consented to by GateMotors in writing.

Once we have checked the price and availability of the goods you will receive confirmation of that order via email. Until your order is received, we have the right to decline the supply of goods - for example, we may not be able to get hold of the model you need although it is showing on our website. If this happens, we will refund you in full. Of course, we will do our utmost to make sure this doesn’t happen, but we do reserve the right not to accept an order.

AVAILABILITY

We rely on computers & humans to manage our stock. Occasionally one or the other will get it wrong. If our stock count is wrong and effects your order, we will tell you as soon as we know, and we will try to sort it out for you.

PRICE

Prices on our website are believed to be correct but may vary without notice. Goods will be invoiced at the price ruling at the date of despatch and we reserve the right to amend any errors or omissions. Value Added Tax (at the current standard rate of 20%) where applicable, will be added at the time of invoicing.

PAYMENT

Accepted payment methods are:

  • Credit/Debit Card
  • PayPal
  • Bank Transfer (Bacs/Fast Payment)
  • Cheque/e-Cheque
  • Cash

Goods paid for by credit card, debit card or PayPal will only be delivered to the registered billing address - unfortunately there are no exceptions to this rule.

Orders paid for by bank transfers, cash or cheque can be delivered to an alternate delivery address once the funds have been verified (please note cheques can take up to 8 working days to clear).

DELIVERY

Every effort is made to meet quoted delivery times and we are proud of our delivery accuracy. However, we cannot guarantee all deliveries will be made as stated. Occasionally something happens out of our control, like adverse weather or road closures which can affect delivery of your order. If this happens please contact us within 24 hours of the planned delivery date and we will make alternative arrangements.

Goods must be checked upon receipt of delivery and contents checked for missing items. This must be done within 24 hours of delivery receipt and any missing items reported in writing to customercare@gatemotors.co.uk.

If you fail to report any missing items within this time period any claim will be void.

If the goods are damaged in transit you must contact us within 24 hours of the date of delivery; we then require a formal claim in writing within 7 days of the date of delivery.

Our deliveries are made with reputed couriers and a signature is always required. If there is nobody available to receive your delivery at your stated delivery address, the courier company will usually leave a card for you to organise collection from your local depot or arrange delivery for another day.

Delivery Failure - If initial delivery is not accepted, nor a collection from the courier depot or re-arranged delivery made the goods will be returned to our premises. If this happens and you request a new delivery an additional delivery charge will be incurred.

For deliveries outside the EU it is possible for you to arrange your own courier service; however, if you choose to use your own courier then VAT will be charged (as there is no proof of export on our behalf). You will be able to claim back your VAT once you provide HMRC with your proof of export.

LIMITED WARRANTY

All goods sold on our website (https://www.gatemotors.co.uk/) come with a limited warranty.

The warranty is on a 'return to base' basis. This means goods must be returned to us for testing before any further action can be taken.

Gate Motors warrants to you that the supplied goods will be free from defects in workmanship and materials under normal use for a period of 1 year from the date the goods were invoiced.

In some cases, the warranty period may be extended to 2 or 3 years by the manufacturer. This will require the product/s to be returned to the manufacturer’s head office or service address. If an item has an extended warranty period it will be stated on its product page on this website.

If a defect arises and a valid claim is received by GateMotors within the warranty period, the goods should be returned as per instructions below.  Shipping costs will be paid by the customer in the first instance. If the goods are deemed faulty then shipping costs will be reimbursed upon proof of purchase.

Any time after the warranty period we are entitled to charge you for any reasonable shipping and handling costs made in connection with the repair or replacement of the goods.

Gate Motors will not be liable for costs incurred relating to removal or re-installation of goods found to have a manufacturing defect.

All goods returned to us for repair or warranty claim will be inspected and repaired/replaced as necessary.

Procedure for returning goods for warranty repair: 

You will be required to prove that you purchased the items directly from us. Please have you order number to hand so that we can trace your transaction.

  • If you believe you need to return any item/s for fault-testing you must first contact technical support on the telephone numbers provided on this website to run through some basic tests. If we are unable to resolve your problem this way, you will then be invited to complete our online Returns Request Form to return the item for further testing. An RAN number will be issued within 3 working days.
  • Once an RAN number has been issued you must return the item with the RAN clearly marked on the outside of the box. The RAN will expire after 21 days and the return will be closed.
  • If the item is found to be faulty and within our 12 month limited warranty period (from date of invoice) we will repair or replace the faulty item/s and return them to you at our expense.
  • If the item has been damaged due to improper installation, it will not be covered under the limited warranty and any repair will be chargeable.
  • In the event of no fault found, a £30 (+VAT) charge will become payable and the item/s will not be returned to you until receipt of the payment. Delivcery costs will also be charged if applicable.
  • All items returned that are outside the limited warranty will incur a testing fee of £30 (+ VAT) before a quotation is proved for any potential repairs.

The Limited Warranty does not apply when:

  • Opened or repaired by someone not authorised by GateMotors
  • Repair or replacement of any goods or part thereof damaged by: misuse, moisture, liquids, proximity or exposure to heat and accident, abuse, non-compliance with the installation and/or usage instructions supplied with the goods, neglect or misapplication.
  • Any disfigurement / removal / tampering of any labels attached to the product will invalidate the warranty.
  • The Limited Warranty does not cover physical damage to the surface of the product or calibration of the product.
  • Adaptions or amendments to any component of a product altering it’s intended design or purpose.
  • Transferring the warranty to any other person. The warranty is only applicable to the original purchaser.

This Limited Warranty does not affect any legal rights under the national legislation governing the Consumer Rights Act 2015.

RETURNS & CANCELLATIONS

Consumers have a statutory right (under the Consumer Rights Act 2015) to return an item without giving a reason. The only exception to this, is against items which have been modified or ordered directly from the manufacturer (Bespoke Order). Under these circumstances you waive the right to return the item for a full refund.

Under the Consumer Rights Act 2015 your cancellation notice must be received by us in a written/printable form within 14 days of delivery of the goods. Once the cancellation notice has been received you then have a further 14 days to return the goods. Please note, you will have to pay for the return of goods.

Goods returned for credit will only be accepted if they are in their original boxes, undamaged and complete with all instructions/documentation.

Before returning goods a Returns Authorisation Number (RAN) should be obtained by submitting our online Returns Request Form.

Failure to obtain a RAN will result in the goods being turned away from our Goods-In and returned to the invoice address as undeliverable.

If you decide to cancel your order you must return the goods to us at your own expense. You must ensure that the goods are packaged sufficiently to protect against damage.

If you fail to take reasonable care of the goods before they are returned to us, and this results in damage, you will be charged for the reduction in value.

If the items have been handled beyond what is necessary to determine whether the product is in working order or as described, we may recover the value lost from the reimbursement we offer you.

This cancellation policy does not affect your legal rights.

LIMITATION OF LIABILITY

We do not exclude liability for the following heads of loss:

  • Death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors.
  • Fraud or fraudulent misrepresentation.
  • Breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession).
  • Breach of the terms implied by sections 13, 14 and 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples).
  • Defective products under the Consumer Protection Act 1987.

In accordance with GateMotors’s policy of progressive improvement, we reserve the right to alter the specification and/or price of any article without prior notice without incurring any liability.

All information and data given in company literature is subject to variation and is for general information only.

All goods or services referred to on outstanding invoices due to GateMotors by the Buyer shall remain the absolute property of GateMotors until payment of all invoiced amounts have been received and cleared. In the event of default by the Buyer responsibility for payment in full of all goods and services ordered by the Buyer together with costs and interest is that of the Buyers Directors either individually or collectively. It is a condition of trading that such Directors will indemnify GateMotors for all costs and losses due howsoever caused.

CHANGES TO THESE TERMS

These terms were last changed on 14th June 2019. These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.

Gate Automation

Please select what type of automation you require for your gate/s. Double & Single Swing refer to motors which attach to the gate and pillar of a swing motion gate. Double & Single Underground refer to motors which lay beneath the ground which attach to the hinge end of swing motion gates. Choose Sliding if you require lateral moving gate automation and Wheeled if you require a motor which utilises a wheeled motor to drive your gate/s.

Motor Voltage

There are two types of power outputs to consider - 24v & 230v. If you need a higher number of operations (opened/closed more than 5-6 times in an hour) during peak periods such as the morning and evening, then you may wish to consider a 24v system.

24v systems are more suitable for higher operation levels as they tend to run cooler than 230v gate motors. However, they do cost more in relative terms, so if you only need to open or close the gate 1-5 times an hour then a 230v system might prove more cost-efficient.

24v motors tend to be used on commercial premises, whereas 230v tend to be used on standard domestic properties. The exception to this rule is sliding gate motors where the reverse is true - 24v sliding gate automation systems tend to be for domestic use, 230v for more intense use (commercial/communal).

24v systems can draw power from battery backup systems meaning they can still operate during any mains power cut (a 230v or 3 phase system would need to be opened with a manual release key).

24v systems can also utilise solar power units as a means of charging batteries, allowing you to site gate automation in rural and remote locations where mains power is unavailable.

Weight of Gate

All electric gate motors operate up to a maximum weight. This is so the gate will operate in a reliable and safe manner. It is essential to know the weight of each gate leaf in order to choose the correct motor for you installation. If you do not know the weight of your gate/s, send us a photo along with the gate/s dimensions and we can advise.

Gate Width

As with weight, gate motors are designed for gates within certain dimensions. The most important dimension is the width of the gate. To ensure you select the right motor to operate your gate you must know the width of each gate that requires automation.

Opening Angle

Each motor has a maximum angle to which it can operate to. Therefore it is important to note how far the gate needs to open in order for a vehicle to enter/exit safely.

Daily Use

The amount of times your gate is used per day is a determining factor when deciding on the right motor for your usage. Motors are designed to operate within a certain capacity (operations per day) so choosing a motor compatible with your desired use is essential for its durability.
