This agreement shall be in accordance with English Law and supersedes any previous Agreement between the buyer and the seller. The placing of an order shall include acceptance of the following terms and conditions. Only our terms shall apply and shall not be deemed as forming part of any other contract; no terms, conditions or reservations stipulated by the Buyer and no course of dealing shall annul, vary or add to any of these conditions unless expressly consented to by Gate Motors in writing. These terms and conditions are in addition to any statutory rights applicable under English law

PRICE

Prices are believed to be correct at time of going to press / website but may vary without notice. Goods will be invoiced at the price ruling at the date of despatch and we reserve the right to amend any errors or omissions. Value Added Tax (at the current standard rate of 20%) where applicable, will be added at the time of invoicing.

PAYMENT

Accepted payment methods are:-

  • Bank Transfer (Bacs/Fast Payment)

Goods paid for by credit card, debit card or PayPal will only be delivered to the registered billing address - there are NO exceptions. Orders paid for by bank transfers can be delivered to an alternate delivery address once the funds have been verified in our account.

Lien. Gate Motors shall have a general lien on any goods, items or any parts thereof or other paraphernalia which are the buyer’s property giving the right to retain possession or to withhold delivery, or of stoppage in transit, until all outstanding payments, costs, expenses, or losses suffered or incurred as the result of any breach of contract of the customer, has been paid for or otherwise satisfied. Should due payment not be received within three months of the due date, Gate Motors will sell or dispose all or part of the retained items in any way that it sees fit without further notice and keep the proceeds of sale in diminution of such sums and all costs incurred by the company in effecting the said sales. Any balance remaining shall be remitted to the customer. Upon any such sale title in the goods shall pass to the purchaser thereof.

DELIVERY

If no specific instructions are included in the customer’s order, consignments will be despatched by our normal route and mode of transport to the usual destination or the destination indicated on the customer’s order. Gate Motors accepts no responsibility for errors where written confirmation has not been received. Every effort is made to meet quoted delivery times, but it is impossible to guarantee them. Gate Motors shall not be liable in any way for failure to deliver on time whatever the reason. NOTE: our deliveries are normally made by Chase Freight APC and a signature is always required due to the high value of our goods. The buyer must examine the goods on receipt of delivery before signing any consignment note. All deliveries will be considered as received in good condition unless you specifically sign as ’damaged’, etc. ’Unchecked’ will not be accepted as a valid status. Your signature on the delivery receipt is your acceptance of the goods arriving in good condition unless they are signed for as damaged. If there is nobody available to receive your delivery at your stated delivery address, the courier company will usually leave a card for you to organise collection from your local depot. If you require redelivery, then each redelivery must be paid for in advance; the cost of each re-delivery will be at 50% of the normal (non-promotional) delivery charge to you or £9 ex-VAT whichever is the greater. Strict enforcement of this delivery policy helps keep our delivery charges to a minimum for the majority of our customers. All goods are packed to ensure safe carriage, and the company cannot accept responsibility for loss or damage in transit. Complaints of loss or damage must be notified to the carriers and Gate Motors within three working days of the date of delivery; a claim must similarly be made within seven days of the date of delivery.

For deliveries outside the EU it is possible for you to arrange your own courier service; however, if you choose to use your own courier then VAT will be charged (as there is no proof of export on our behalf). You will be able to claim back your VAT once you provide HMRC with your proof of export.

Occasionally we may need to have an item sent direct from the manufacturer/supplier. This may affect the delivery times, if this is the case, you will be notified and given an estimated time scale for delivery.

PLEASE NOTE: Our Next Day Service is a Next Working Day Service and as such, does not include weekends or bank holidays.

 

ACCEPTANCE OF GOODS

We reserve the right to require the customers to take delivery of goods ordered at the agreed times, or, where goods cannot be accepted at these times, to render invoices for instruments completed, payments to be effected within our stated credit terms.

SUITABILITY OF PRODUCT

We accept no responsibility that goods stipulated by you are sufficient for any particular purpose. Verbal instructions are accepted on the basis that Gate Motors will not be held responsible for mistakes arising thereof.

WARRANTY

The 12 months Limited Warranty on all goods supplied by Gate Motors is on a return for repair basis. Any longer warranty issued by a manufacturer will require these to be returned to the manufacturer’s head office or service address, in or outside the United Kingdom. Gate Motors shall not be liable in any way for failure of any product supplied. In particular Gate Motors shall not be liable for labour costs involved in replacing faulty items or fault finding. Gate Motors warrants to you that the supplied goods will be free from defects in workmanship and materials under normal use for a period of one (1) year from the date that the goods were first purchased by you. If a defect arises and a valid claim under this Limited Warranty is received by GateMotors after the first one hundred and eighty (180) days of the warranty period, Gate Motors is entitled to charge you for any reasonable shipping and handling costs made in connection with the repair or replacement of the goods. You must comply with any other return procedures stipulated by Gate Motors, if any.

What This Warranty Does Not Cover The Limited Warranty does not apply when the goods have been opened or repaired by someone not authorised by GateMotors and does not cover repair or replacement of any goods or part thereof damaged by: misuse, moisture, liquids, proximity or exposure to heat and accident, abuse, non-compliance with the installation and/or usage instructions supplied with the goods, neglect or misapplication. Any disfigurement / removal / tampering of any labels attached to the product, will invalidate the warranty. The Limited Warranty does not cover physical damage to the surface of the product or calibration of the product. This Limited Warranty cannot be transferred to any other person. This Limited Warranty does not affect any legal rights under applicable national legislation governing the sale of consumer goods.

OBTAINING REPAIRS & REPLACEMENTS

(In warranty & out of warranty) Goods should not be returned for repair or warranty claim without first obtaining a Returns Authorisation Number (RAN) failure to obtain a RAN will result in the returned goods being turned away from our Goods-In and returned to the invoice address as undeliverable. In addition, goods returned for repair or warranty claim must be accompanied by a note indicating the nature of the suspected defect, showing clearly the returnee's full name and address and giving proof of purchase from Gate Motors. All goods returned to us for repair or warranty claim will be inspected and repaired / replaced as necessary. In warranty repairs will not carry any parts or labour charges, provided the products were found to be faulty due to component failure. Out of warranty repairs will be subject to charges which cover the labour, replacement components and carriage. We will excise a Lien as described above, where payment for goods or services has not been made. Where we deem a repair to be uneconomical, we will contact you for a decision on our course of action.

ADVANCE REPLACEMENT

Replacement items for goods not manufactured by Gate Motors will only be arranged after prior agreement with the manufacturer. The 12 month warranty on all goods supplied by Gate Motors is on a return for repair basis and not to send out advance replacements. At our discretion and only to credit account holders GateMotors may agree to send out advance replacements though this service is not to be expected. Gate Motors shall not be liable in any way for failure of any product supplied. In particular Gate Motors shall not be liable for labour costs involved in replacing faulty items or fault finding.

RETURNS & CANCELLATIONS

Any product that needs to be returned to Gate Motors (whether in warranty or not) will only be accepted when accompanied by our Returns Authorisation document - this document is included with your goods or can be faxed / emailed to you from our office. The document must be filled in with as much information as possible, to enable us to administer the product(s) when they are received at our Goods-In department. Any goods received without the documentation will not be processed. Goods returned for credit will only be accepted if they are in their original boxes, undamaged and complete with instructions etcetera. Gate Motors may accept the goods back under the following conditions: The items were not specially ordered for you or your client ie Safety Edges are a special order item as they are cut to size; We receive a written / printable notice of your return (we will then issue a RAN); The goods are returned to us within 14 days of delivery of the goods; The goods have not been installed; The goods are returned as complete items; All packaging, fixing kits and instructions are as new.

A minimum re-stocking/handling charge of 20% will be made for all goods returned for credit and all will be subject to our discretion. If any of the above conditions do not apply, then Gate Motors reserve the right to refuse the goods back. Consumers have a statutory right to return an item without giving a reason (except specially ordered items) under the Distance Selling Regulations; if you need to do this, then your cancellation notice must be received by us in a written / printable form within fourteen days of delivery of the goods; we will then issue you with a RAN which must accompany the goods; you will be responsible for paying for the return of goods. We will refund your money within 30 days of receipt of cancellation providing you have returned the goods to us undamaged. The cost of returning the goods will be at your own expense.

LIMITATION OF LIABILITY

Neither Gate Motors nor its suppliers shall be liable to you or to any third party for any damages either direct, indirect, incidental, consequential or otherwise (including in each case, but not limited to, damages for the inability to use the equipment, loss of business, loss of profits, business interruption or the like) arising out of the use of or inability to use the goods even if Gate Motors has been advised of the possibility of such damages. Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced herein and all direct or general damages in contract or anything else), the entire liability of Gate Motors and any of its suppliers shall be limited to the amount actually paid by you for the goods. Now GateMotors shall not be liable for (i) any fraud on the part of its employees and/or agents; or (ii) any fraudulent misrepresentation on the part of its employees and /or agents. Notwithstanding the above, neither party’s liability for death or personal injury resulting from its own negligence shall be limited. If any of these terms shall become or be declared illegal, invalid or unenforceable for any reason whatsoever such term shall be divisible from these terms and shall be deemed to be deleted from them.

GENERAL

In accordance with Gate Motors’s policy of progressive improvement, we reserve the right to alter the specification and/or price of any article without prior notice without incurring any liability. All information and data given in company literature is subject to variation and is for general information only. All goods or services referred to on outstanding invoices due to Gate Motors by the Buyer shall remain the absolute property of GateMotors until payment of all invoiced amounts have been received and cleared. In the event of default by the Buyer responsibility for payment in full of all goods and services ordered by the Buyer together with costs and interest is that of the Buyers Directors either individually or collectively. It is a condition of trading that such Directors will indemnify Gate Motors for all costs and losses due howsoever caused.

By recycling your used batteries via dedicated battery collection points you are contributing to protecting our environment and the earth's natural resources.

Batteries are made from important resources and chemicals, including lead, cadmium, zinc, lithium and mercury. If batteries are disposed of as normal municipal household waste, they will be taken to a landfill site and those resources will be lost and will contribute to the pollution of the environment. Recycling is one way you can help the environment and you should dispose of used batteries separately from other waste, using the collection and recycling schemes available.

Your role in contributing to the recycling of waste batteries and in preventing pollution of the environment is essential. Each used battery that you place in a recycling box will be taken apart and many of the materials will be recovered and used to make new batteries or something else.

All batteries are labeled with the crossed-out wheeled bin below, to indicate that they should not be disposed of as normal waste, but in specific recycling centres.

Batteries containing hazardous substances such as mercury (Hg), cadmium (Cd) or lead (Pb) are marked with their chemical symbol as well.

You may also contact your local authority for information on a recycling facility in your area that will take back your used batteries. For used car batteries please contact you nearest Civic Amenity Site, or check the above link by carefully looking in the results which of the sites listed will accept car batteries for recycling.

The Waste Electrical and Electronic Equipment Regulations (WEEE Regulations)

The Waste Electrical and Electronic Equipment Regulations are now part of UK law. The UK have agreed to reduce the amount of WEEE that is being disposed of in landfill sites.

It is important that the amount of WEEE sent to landfill sites is reduced because:

Some WEEE can be re-used or recycled. The amount of landfill space available in the UK is decreasing. If we can keep WEEE out of landfill sites it means there is more landfill space available for non-recyclable waste.

WEEE can contain hazardous substances. When left in landfill sites the hazardous substances in WEEE can pollute soil and contaminate water supplies. This contamination can damage human health and the environment.

Distributors of new Electric and Electronic Equipment (or EEE) have a part to play in reducing the amount of WEEE going into landfill sites.

GateMotors.co.uk are "doing our bit" under these regulations by offering our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product.

For example, if a customer buys a new keyfob from us we will take back their old keyfob(provided it is of equivalent type and function) and prevent it going into a landfill site by disposing of it safely. Customers must return their old WEEE within 28 days of purchasing their new item. Customers do have to pay to return their old item to us.

Gate Automation

Please select what type of automation you require for your gate/s. Double & Single Swing refer to motors which attach to the gate and pillar of a swing motion gate. Double & Single Underground refer to motors which lay beneath the ground which attach to the hinge end of swing motion gates. Choose Sliding if you require lateral moving gate automation and Wheeled if you require a motor which utilises a wheeled motor to drive your gate/s.

Motor Voltage

There are two types of power outputs to consider - 24v & 230v. If you need a higher number of operations (opened/closed more than 5-6 times in an hour) during peak periods such as the morning and evening, then you may wish to consider a 24v system.

24v systems are more suitable for higher operation levels as they tend to run cooler than 230v gate motors. However, they do cost more in relative terms, so if you only need to open or close the gate 1-5 times an hour then a 230v system might prove more cost-efficient.

24v motors tend to be used on commercial premises, whereas 230v tend to be used on standard domestic properties. The exception to this rule is sliding gate motors where the reverse is true - 24v sliding gate automation systems tend to be for domestic use, 230v for more intense use (commercial/communal).

24v systems can draw power from battery backup systems meaning they can still operate during any mains power cut (a 230v or 3 phase system would need to be opened with a manual release key).

24v systems can also utilise solar power units as a means of charging batteries, allowing you to site gate automation in rural and remote locations where mains power is unavailable.

Weight of Gate

All electric gate motors operate up to a maximum weight. This is so the gate will operate in a reliable and safe manner. It is essential to know the weight of each gate leaf in order to choose the correct motor for you installation. If you do not know the weight of your gate/s, send us a photo along with the gate/s dimensions and we can advise.

Gate Width

As with weight, gate motors are designed for gates within certain dimensions. The most important dimension is the width of the gate. To ensure you select the right motor to operate your gate you must know the width of each gate that requires automation.

Opening Angle

Each motor has a maximum angle to which it can operate to. Therefore it is important to note how far the gate needs to open in order for a vehicle to enter/exit safely.

Daily Use

The amount of times your gate is used per day is a determining factor when deciding on the right motor for your usage. Motors are designed to operate within a certain capacity (operations per day) so choosing a motor compatible with your desired use is essential for its durability.
